I don't think the O$bournes need any permission at all. Out of respect they decided to keep low profile for Randy marketing. And I think they didn't ask permission for this clip either. Not many fans gonna buy a dvd only for that 5 seconds Randy saying "Happy Birthday". In fact it's nothing but at the same time maybe a wink to the fans. Who knows? Footage that shows Randy recording the Mr. Crowley solos would be something different right? That would sell..... I think one day the O$bournes gonna start to cash in anyway, permission or not. And when they do they will explain why it took so long without going too much into details.....

Also, if S&O can fight and win a legal battle and prevent Lee and Bob getting money for 2 of the most cutting edge albums in rock history, I don't think they would shy away from releasing Randy footage. I think that it demonstates they are biding there time and waiting for what they decide is the right moment.
We will see it on the day the decided we can. Unless it's what we ourselves find.

I think Paul's close on this one. I think the Osbournes would need permission to use Randy's name and image and all that on something like this...I don't believe for one minute that Sharon owns or controls the Rhoads estate. I remember reading an interview over with the Jackson guitar people and they said that Mrs. Rhoads pretty much owned the company because Randy's model did so well.
Not to comment on the whole Osbournes owning the Randy image and using a simple Happy Birthday thing lure or tease or whatever fans...I do think that's silly. I seriously don't see why they couldn't at least find some footage of Randy sitting down on a couch with a guitar just strumming or something. It would make a lot more sense than him saying happy birthday. I think they're scraping the barrels for Randy type footage and this is all they could come up with.

If there was a whole buncha footage(and I'm sure there's some), the only reason I can see it not being released is because of Delores's wishes....What would the Osbournes be waiting for?....30th anniversary of his death?...
I'm sure he's on some home movies and stuff....I know Sharon/Ozzy love $$$, but I'm sure some stuff is sacred even to them....I honestly don't think we'll ever see anything major ever released....
I really am not sure about all this talk about about rare unseen footage of Randy. As much as I'd love there to be some out there, I do find it very unlikely. Yes there may be a bit of home-movie footage of him goofing around or something similar, but I personally find that hard to get too excited about. Live footage, studio footage or even him just jamming on his guitar would be great, but as time moves on the less likely it'll happen in my eyes. But I hope I'm wrong.
If Sharon and Ozzy are supposedly waiting until the time is right, well, we could wait forever. To this day Ozzy still talks very highly of Randy, and yet in all the hundreds/thousands of interviews he's done he's never once mentioned anything of any unseen video footage that one day will be available. If there was ever a right time I suppose that was 21 years ago in 1987, when Tribute was released. That would have been the perfect time, live footage to acompany the record, but alas, it didn't happen. Unfortunatley I think that's it.

Thing is something very embarassing happened in the past, and out of respect for somebody's wishes nothing more has een released since then. Technically the O$bournes can release what and whenever they want. Remember even Randy couldn't get out easily when he wanted......

Lee was basically talking about Sharon's business sense, and that although he didn't agree with all she's done obviously, he said you had to respect what she had done. He was a good interview, I'd love to see more from him.

In all honesty i dont think anything would be stopping the osbournes releasing live footage of a performance.
As far as my knowledge goes on release forms and stuff like this i cant imagine the record companies or delores could do much to stop them, unless they funded it etc. The record company could at best demand at percentage of profits, the same with Delores. Again the same with Bob and Lee or Tommy and Rudy.
Ozzy is credited with writing those songs, he owns them as much as anyone else. so if he released footage of himself playing those songs no one can really do anything. It could go to court but the osbournes would win.
The only deal left would be image rights. And if the osbournes had planed to record their lovely stage set (as most of us agrees makes sense) they would have tied up image rights of the stars e.g. the band well in advance. I honestly dont see how sharon would be so stupid not to.
That only leaves us with the scenario of them respecting Delores' wishes and if they are as money hungry as they're supposed to be that wouldnt stop them.

in that case it really depends on just how long the osbournes wnat ozzy's name to be in the public gaze (at least where metal is concerned). They'll get their money one way or the other but maybe they just want ozzy to keep his name in the spotlight another 10 (or 20 ) years
kinda ridiculous though, i mean its not as though he hasnt left his mark on the music business.
I would be shocked if there isn't at least home video footage of the Diary tour in the Osbourne archives. Like I've said before, the old Sabbath demo stuff they put on The Ozzman Cometh was stuff Ozzy said he didn't even know he had, just kind of stumbled upon it during a move. I'm sure there's all sorts of personal home movies etc that they filmed on the road that we'll probably never get to see, stuff that we would kill to see.

Mrs. Rhoads copyrighted Randy's name and likeness. That means she has legal right to anything bearing his image or his name. Without her authorization, nothing can be legally released with Randy's name or likeness.
As for who wrote the songs/owns them... watch the Guitar World Disc that comes with the magazine. Dave Mustaine plays his musical examples "upside down" so that copyright and royalty issues are not affected - and he's playing his own songs! The legalities in the music world are stupifyingly complex.
