For those who don't have access to YouTube, Eddie Trunk asks Jake the circumstances of signing and not having credits for Bark. Jake states that before recording Bark that he was told he would get a share of the credits with writing and royalties. He says okay and they start recording at Ridge Farm, throughout the recording he's asking where the contract is. When he finally records his last track he receives the contract and it states that Jake will not get credit for writing the songs and that Ozzy will receive all writing credits and that Jake is not allowed to publicly state otherwise.

Jake goes to Sharon and says that this isn't what he agreed to and Sharon states "No it isn't" so when Jake asks "then why should I sign this" Sharon goes on to tell him that if he doesn't sign it that they'll get him a bus ticket home, he can get in line to sue them meanwhile they'll get a new guitarist to come in and record the tracks and he'll get nothing.

Good interview on a bunch of subjects.

So what can we learn from this? Get shit in writing before you do anything. I have real life lessons for this as well. You will get screwed, more than likely, of don't do this up front. It is a damn shame that some people cant keep their words.

I agree it's a shame, and should not have happened, but wouldn't it have been good practice to insist on having a signed contract BEFORE recording started?

I always feel bad for people this happens to, but I also wonder why they haven't done their due diligence previous to participating in sessions. I understand that sometimes circumstances and timelines are rigid, and sessions need to get underway, but any people worth dealing with and are on the up and up won't mind having all the legal matters out of the way.

Obviously the O's are all about themselves...in particular, Sharon. It's sad.

well put yourself in jakes shoes ... you are a young guy trying to "make it" and a huge name in music wants you in his band. I think the brain is gonna step out for a while and pure emotion is going to rule your head. He would have no reason to think he was going to be screwed over. My understanding is he did get a lump sum for TUS

It's the whole Robert-Johnson-made-a-deal-with-the-devil-down-at-the-crossroads thing... Jake wanted the stardom and made a deal... it's nice that he was stating it matter-of-factly rather than whining about it. He knows he made a mistake and it'd be nice to have a "do over" but he knows that's not realistic. He also knows that, credit or not, everyone knows who wrote the songs.

Wonder what kind of "deal" Zakk made with the devil for No Rest for the Wicked?

I think Jake got his writing credits for The Ultimate Sin though, right?
And Zakk is clearly credited and as far as we known, treated fairly well by The Osbournes.
I think that might have come down to timing though. When Jake signed on to play with Ozzy, Sharon and Ozzy were in dire straights and were trying to get money to pay off their own legal fees as a result to battling Don. When Zakk rolled around, maybe times were easier and therefore they didn't need to be as underhanded.

Signing shitty deals is apart of life in the music industry. It happened to Jake, it happened to Sabbath, it happened to Zeppelin and so many others. Rule 1.) Demand a contract up front. 2.) Get a lawyer. 3.) Don't do so many drugs.
Imagine how many musicians would have been compensated for their work!

Then again, maybe some classic albums might have never have been made if the 3 rules above were followed...

yeah jake demanded a contract before recording TUS so he is credited, not sure if he gets $$ now or if he took a lump sum

I think you are bang on with everything you posted. Also people seem to forget the sharons dad Don was screwing every one over before she took over as well ... I guess in theory she came in and saved every one from Don and then did exactly the same thing to them (apart from ozzy of coarse)
